第一条 为加强犬类管理,防止狂犬病发生,保障人民生命安全和社会秩序安定。根据国家有关规定,结合本省实际,制定本办法。

第二条 县以上城市(包括县镇、下同)市区、近郊区、新兴工业区、游览区、港口、机场周围,严禁养犬,但有关单位确因警卫、科研、军警工作需要养犬以及居民饲养宠物犬的除外。

宠物犬的范围由省人民政府公安机关会同省畜牧兽医部门确定后,向社会公布。

第三条 市、县(区)人民政府可以对本行政区域内的特定地区划定范围禁止养犬,并可以将其他非禁止养犬地区划分为重点管理区和一般管理区。

禁止在主要道路、广场和其他公共场所遛犬。主要道路名录由市、县(区)人民政府确定后,向社会公布。

市、县(区)人民政府可以在重大节假日或者举办重大活动期间划定范围禁止遛犬。

第四条 居民饲养宠物犬的,必须符合下列条件:

(一) 有本市、县(区)常住户口;

(二) 单户居住;

(三) 有完全民事行为能力。

第五条 本办法第二条第一款规定范围内的有关单位需要养犬、居民需要饲养宠物犬的,应当向所在地的市、县(区)公安机关提出申请;其中,居民在提出申请前,应当先征得居民委员会的同意。市、县(区)公安机关应当自收到申请之日起20个工作日内作出决定。对符合条件的,发给《犬类准养证》,每犬一证;对不符合条件的,不予批准,并说明理由。

第六条 凡养犬的单位或个人,应携所养犬到当地畜牧兽医部门注射兽用狂犬病疫苗,按规定进行登记、缴费、挂牌,领取《家犬免疫证》和“家犬免疫牌”。

第七条 《犬类准养证》、《家犬免疫证》和“家犬免疫牌”由省有关部门统一制定。所发证、牌不得转借、冒用、涂改、伪造和买卖。

第八条 凡获准养犬的单位或个人所购犬类,如无《家犬免疫证》、“家犬免疫牌”的,应一律圈养或拴养,并应限一定期限及时向当地畜牧兽医部门申请检疫,注射疫苗。

第九条 凡未挂“家犬免疫牌”的犬,一律视为野犬,城市由公安部门负责捕杀,农村由乡、镇人民政府组织力量(或指定人员)捕杀。畜牧兽医、卫生等部门应积极配合捕杀狂犬、野犬,狂犬尸体必须焚烧或深埋,严禁出售或食用。

第十条 凡携带犬的各种马戏团,到当地演出之前,应向县 (市、区)级公安部门或乡、镇人民政府出示《犬类准养证》等,经准许后,方可演出。否则,公安部门和乡、镇人民政府应禁止其在本地演出。

第十一条 获准养犬的单位和个人,必须遵守下列规定:

(一)每年四月底以前,向发证机关缴纳管理费。其中,重点管理区每只犬第一年为500元,以后每年度为300元;一般管理区内的收费标准由市、县人民政府根据实际情况确定;农村地区养犬免收管理费。对盲人养导盲犬和肢体重残人养扶助犬,以及有关单位养军警用犬、科研用犬的,免收管理费。对养绝育犬的或者生活困难的鳏寡老人养犬的,减半收取管理费。犬主应当每年携犬到当地畜牧兽医站按指定的时间、地点由兽医人员给犬注射疫苗,办理免疫手续,并在颈部挂上“家犬免疫牌”。犬的免疫注射费由畜牧兽医站按省价格、财政部门的有关规定收取。养犬缴纳的管理费全部上缴国库,纳入财政预算管理。养犬管理工作所需经费纳入有关部门的部门预算。

(二) 犬咬伤家畜和糟蹋庄稼等物,犬主应当作必要的赔偿;犬若伤人,应当及时报告当地公安部门或者乡、镇人民政府,犬主必须承担被咬者的全部医疗费和误工损失等。

(三)妥善保管《犬类准养证》、《家犬免疫证》和“家犬免疫牌”,以备公安、畜牧兽医、卫生部门和犬类管理人员检查。如有损坏或丢失,应向原发证机关书面申诉原因,申请换发和补发,并交纳所规定的管理费和免疫注射费。

(四)犬如死亡、宰杀出卖或赠送后,应及时向原发证机关办理注销或过户手续。

第十二条 外贸、供销、商业等部门,只准收购、宰杀、出售持有《家犬免疫证》和“家犬免疫牌”的犬只和犬皮。

第十三条 对单位和个人无证养的犬,公安部门和乡、镇人民政府可责令限期宰杀或强制捕杀,对单位处以1000元以下罚款,对个人处以200元以下罚款,并责令补缴管理费。

因违反本办法造成严重后果,使人致残致死的,由司法机关依法追究刑事责任。

第十四条 发生狂犬病疫情的地区,县以上人民政府有权对本地区所有养犬采取应急灭犬措施。

第十五条 对违反本办法的养犬户,城镇由公安部门负责处理,畜牧兽医、卫生部门负有监督的责任;农村由乡、镇人民政府负责处理。公安、畜牧兽医、卫生部门应各司其职,各负其责,相互配合,每年应联合组织检查本办法执行和落实情况,并向同级人民政府报告。

第十六条 《中华人民共和国动物防疫法》和《江西省动物防疫条例》对犬类管理另有规定的,从其规定。

第十七条 本办法自一九八七年十月一日起施行。

中外合资、合作经营企业机电产品以产顶进管理办法(附英文)

第一条 根据国务院批准由国家计委发布的《关于中外合资、合作经营企业产品以产顶进办法》的有关规定,特制订本办法。
第二条 凡具备下列各项条件的企业,可以申请将其产品列入《机电产品以产顶进目录》(以下简称目录):
1、能够提供国内需要的先进技术,从事新产品开发,实现产品升级换代的中外合资、合作经营企业(以下简称企业),因外汇平衡出现暂时困难,需要给予扶持的;
2、企业生产的机电产品与国外同类产品的性能和质量相同,能满足国内用户的需要,售价不高于国外同类产品进口价(完税后价格)的;
3、企业生产的机电产品属于国内用户需要进口的;
4、企业按批准的合同履行外销责任。
第三条 凡要求产品以产顶进的中外合资、合作经营项目,应在报批可行性研究报告时对以产顶进的可行性进行充分的论证和评估。
第四条 企业投产后,其产品符合上述第二条的规定要求列入国家以产顶进目录的,由企业向产品归口部门提出申请,抄报国家经委、经贸部和当地经委。申请时,须附送机电产品以产顶进申请表、产品质量证明文件、市场需求预测的调查报告,由产品归口部门审核签署意见,报国家经委会同国家外汇管理局审批,审批时间一般不超过两个月,并由国家经委公布实施。
第五条 需要目录内产品的用户可直接向企业订货,或由中国机电设备招标中心(或经国家经委批准的招标公司)按国家有关规定在国内组织招标,指导用户在国内选购,以代替进口。
第六条 企业销售国家以产顶进目录内的机电产品,经外汇管理部门批准,允许收取部分外汇,并要依据合同或可行性研究报告规定的国产化进度逐年递减。
第七条 企业生产国家以产顶进目录内的机电产品需要进口的散件、零部件、元器件、配套件和原材料,可由海关作为保税货物监管。国内用户直接从国外进口这类机电产品时享受减免进口税待遇的,企业生产的同类机电产品如售给这些用户时,所进口的料、件也可享受同样的减免税待遇。
第八条 本办法由国家经委负责解释。
第九条 本办法自公布之日起施行。
国家经委同时还公布了第一批机电产品以产顶进目录:一是SPECTRUM--集中分散型控制系统(含现场输入、输出装置,每站1024BIT数据采集装置,顺序控制、编程控制装置,CRT操作站,工业控制机),生产企业是上海福克斯波罗有限公司;二是MICONIC--B 交调电梯(额定速度1.6M/S,载重1000KG),生产企业是中国迅达电梯公司上海电梯厂。

MEASURES FOR THE CONTROL OF THE SUBSTITUTION OF MACHINERY AND
ELECTRICAL APPLIANCES MANUFACTURED BY CHINESE-FOREIGN EQUITY JOINT VEN-
TURES AND CHINESE-FOREIGN CONTRACTUAL JOINT VENTURES FOR SIMILAR IMPORTED
PRODUCTS
(Approved by the State Council and promulgated by the State Econo-
mic Commission on October 7, 1987)
Article 1
These Measures are formulated in accordance with the pertinent provisions
in Procedures for the Substitution of Products Manufactured by Chinese-
foreign Equity Joint Ventures and Chinese-foreign Contractual Joint
Ventures for Similar Imported Products, approved by the State Council and
promulgated by the State Planning Commission.
Article 2
Enterprises which satisfy the following conditions may make an application
for the inclusion of their products in the Catalogue of the Substitution
of Home-made Machinery and Electrical Appliances for Similar Imported
Products (hereinafter referred to as the "Catalogue"):
(1) Chinese-foreign equity joint ventures and Chinese-foreign contractual
joint ventures (hereinafter referred to as "the enterprises"), which are
capable of providing advanced technology that satisfies domestic needs,
and are engaged in the development of new products, thereby realizing the
upgrading of products and the replacement of old products with new ones,
but which are at present confronted with the temporary difficulties of an
imbalance in foreign exchange and are badly in need of support;
(2) the machinery and electrical appliances manufactured by the
enterprises are the same in performance and quality as similar products
produced in foreign countries, they can satisfy the needs of domestic
users, and their prices (the prices after taxation) are no higher than the
prices of similar imported products produced abroad;
(3) the machinery and electrical appliances manufactured by the
enterprises are in the categories that the domestic users want to import;
(4) the enterprises execute their obligations to export products in
accordance with the approved contracts.
Article 3
Chinese-foreign equity joint ventures and Chinese-foreign contractual
joint ventures, which apply for the substitution of their products for
similar imported foreign goods, shall prove by an ample demonstration and
appraise the feasibility of substituting their products for similar
imported ones at the time when they submit their feasibility studies
report for examination and approval.
Article 4
After the enterprises have gone into production, if their products are in
conformity with the stipulations of Article 2 mentioned above and they
request to have their products included in the State catalogue of the
substitution of home-made products for similar imported ones, the
enterprises shall make an application to the department concerned, and
submit duplicates of the application separately to the State Economic
Commission, the Ministry of Foreign Economic Relations and Trade, and the
local economic commission. The application shall be accompanied with an
application form for the substitution of home-made machinery and
electrical appliances for similar imported products, a certification
document testifying to the quality of the products, and report on market
demand projection for the said products; and the application shall be
examined and verified by the department concerned which shall, after
affixing its comments and seal to the application, transmit the
application to the State Economic Commission and the State Administration
of Foreign Exchange Control for examination and approval. Generally, the
period of time for the examination and approval shall not exceed two
months, and the approved items shall be promulgated by the State Economic
Commission for execution.
Article 5
The users who need the products listed in the Catalogue may place an order
directly with the enterprises, or the China Bidding Center for Machinery
and Electrical Equipment (or other bidding agencies authorized by the
State Economic Commission) shall, in accordance with the pertinent
provisions promulgated by the State, organize bidding, thus providing
advice to users for purchasing home-made products to substitute for
similar imported ones.
Article 6
Enterprises which sell machinery and electrical appliances listed in the
State catalogue of the substitution of home-made products for similar
imported goods may, with the approval of the administration of foreign
exchange control, collect part of the payment for goods in foreign
exchange, and the amount shall decrease progressively in accordance with
the rate of progress for the replacement of imported products with home-
made ones, specified in the contract or feasibility studies report.
Article 7
The bulk parts, spare parts, components, fittings and raw materials, which
the enterprises need for the production of machinery and electrical
appliances listed in the State catalogue of the substitution of home-made
products for similar imported goods, may be considered as bonded goods and
be placed under the surveillance of the Customs. Where the users enjoy
the preferential treatment of reduction of or exemption from duties when
they import the aforesaid machinery and electrical appliances directly
from abroad, the enterprises shall enjoy the same preferential treatment
of reduction of or exemption from duties when they import the said raw
materials, spare parts and components to produce similar machinery and
electrical appliances and sell them to the said users.
Article 8
The right to interpret these Measures shall reside in the State Economic
Commission.
Article 9
These Measures shall go into effect as of the date of promulgation.
Appendix
The catalogues of the first lot of machinery and electrical appliances
used in substituting for similar imported products and promulgated
simultaneously by the State Economic Commission: the first is SPECTRUM -
the control system of the centralized/decentralized type (including field
input/output installations, each station 1024 BIT data collecting set,
sequence control, programming control set, CRT operating station,
industrial controller), the enterprise that produces these products is the
Shanghai Fawkes-Polo Co. Ltd.; the second is MICONIC - B elevator (rated
speed 1.6 M/S, carrying capacity 1,000 KG), the enterprise that produces
this product is the Shanghai Elevators Factory of the China Schindler
Elevators Company.

关于排污申报登记法律适用问题的复函

江苏省环境保护厅:

你厅《关于排污申报登记是“实报”还是“预报”问题的请示》(苏环控[2001]43号)收悉。经研究,函复如下:

根据《水污染防治法》第十四条、《大气污染防治法》第十二条和《海洋环境保护法》第三十二条的规定,排放污染物的单位必须按照国务院环境保护行政主管部门的规定,向所在地的环境保护部门申报登记拥有的污染物排放设施、处理设施和在正常作业条件下排放污染物的种类、数量和浓度,并提供防治污染方面的有关技术资料。

《固体废物污染环境防治法》第三十一条规定:“国家实行工业固体废物申报登记制度。产生工业固体废物的单位必须按照国务院环境保护行政主管部门的规定,向所在地县级以上地方人民政府环境保护行政主管部门提供工业固体废物的产生量、流向、贮存、处置等有关资料”。

《环境噪声污染防治法》第二十四条规定:在工业生产中因使用固定的设备造成环境噪声污染的工业企业,必须按照国务院环境保护行政主管部门的规定,向所在地的县级以上地方人民政府环境保护行政主管部门申报拥有的造成环境噪声污染的设备的种类、数量以及在正常作业条件下所发出的噪声值和防治环境噪声污染的设施情况,并提供防治噪声污染的技术资料。

根据以上法律规定,产生和排放污染物的单位,均应如实地申报在正常作业条件下的排污情况。所谓排污申报存在“预报”与“实报”之分的观点没有法律依据。
